Terms and Conditions of Service

This is an agreement between you and Curb Caddie LLC (and its affiliates, "CurbCaddie" or "we"). Before using CurbCaddie, please read these CurbCaddie Terms and Conditions of Service, the CurbCaddie Privacy Policy, the CurbCaddie Recurring Payment Terms and Conditions, and the other applicable rules, policies, and terms posted on the CurbCaddie website or available through your CurbCaddie app (collectively, this "Agreement"). By using CurbCaddie, you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use CurbCaddie.

You agree to have contracted with Curb Caddie LLC to perform the service of taking out and returning your waste and recycling cans at the address specified. You agree that this is a monthly Service Contract and you agree to pay CurbCaddie monthly in advance of the services to be provided for that month.

For the purposes of these Curb Caddie Terms and Conditions of Service:

"CurbCaddie" means Curb Caddie's can management service, including the Curb Caddie app and other related services.

"Software" means all software (including any updates or new versions), and any related documentation, that we make available to you for use in connection with CurbCaddie.

"CurbRunners" means persons employed or contracted by Curb Caddie LLC to provide Curb Caddie's can management service.

Home Access

By submitting your service subscription request online, you are authorizing CurbCaddie and its CurbRunners to access your property (or other location) that you designate for the purpose of taking out and returning your waste and recycling cans. By subscribing to our service, you are confirming that you have the right to authorize CurbCaddie and its CurbRunners to access the designated property. It is your responsibility to ensure that CurbCaddie or its CurbRunners have full access to your trash and recycling cans on the scheduled service dates. Should CurbCaddie or its CurbRunners arrive and be unable to provide service due to lack of access, you shall not be entitled to a credit or refund.

Service

CurbCaddie or its CurbRunners will take out your trash and/or recycling cans the day prior on your designated waste collection day. After your trash and/or recycling items have been picked-up, CurbCaddie will return your cans to the original storage location. You agree that for a flat monthly fee CurbCaddie will take out and return 1 trash can and 1 recycling can per week for 1 calendar month. That is 2 service visits per week.

Can Access

You must ensure CurbCaddie or its CurbRunners have access to your trash and recycling can on the scheduled service day, including but not limited to: gate entry codes, lock combinations, security guard verification, and pets relocated from storage areas. If CurbCaddie or its CurbRunners are unable to access your trash or recycling cans for any reason, services will not be performed that week and you shall not be entitled to a credit or refund. CurbCaddie reserves the right to decline its service for any reason. To ensure smooth service delivery, it is essential that accurate and complete information regarding the location of your trash cans and any necessary access instructions is provided. Failure to supply this information may result in service issues. We cannot be held responsible for non-delivery of service in these circumstances.

Pet Management

Property owners and residents must secure and restrain their pets during scheduled service times. If a CurbRunner encounters an unrestrained pet that creates an unsafe environment, service may not be completed for your property. If you have opted for notifications, we will inform you via text message or email that service could not be completed due to pet-related safety concerns. Please note that no credits, refunds, or service adjustments will be provided if service cannot be completed because of unrestrained pets. We prioritize the safety of both your pets and our service providers, so please ensure all animals are properly contained before your scheduled service time.

Vehicle Considerations

CurbCaddie takes great care to position your waste and recycling containers at curbside for municipal collection. However, we cannot accept responsibility for any damage that may occur if a vehicle strikes or knocks over your containers. Neither damage to the containers nor damage to vehicles that may come into contact with the containers will be the responsibility of CurbCaddie. We encourage you to position parked vehicles with consideration for trash collection access.

Garage Access Agreement

When providing garage access for trash can service, you must ensure your garage is hazard-free and safe. You are responsible for disabling security systems; CurbCaddie and its associates are not responsible for security system management or consequences resulting from disabled systems. By providing garage access and entry codes, you acknowledge: 1) You assume all associated risks, 2) CurbCaddie and its associates will not be liable for missing items from the garage, damage to garage doors or opening mechanisms, or instances where the garage door remains open. While we commit to responsible garage access practices, we cannot accept liability for issues arising from the access you grant. Your provision of garage access confirms your understanding and acceptance of these terms and limitations.

Safety Compliance

Property owners and residents bear full responsibility for maintaining compliance with all municipal codes and regulations regarding property features such as gates, fencing, waste management systems, and other safety-related matters. CurbCaddie provides its services under the assumption that your property meets all relevant local safety requirements.

Container Loading Standards

To ensure the safety of our CurbRunners and prevent potential injuries or property damage, all waste containers must not be overloaded, and lids must close properly according to municipal guidelines. Overfilled containers with unsealed lids create significant safety hazards and operational challenges. If our team finds your containers to be overloaded or improperly closed, we reserve the right to withhold service. No service credits, refunds, or adjustments will be issued in these circumstances. We appreciate your cooperation in maintaining safe working conditions for our service providers.

Excess Waste and Accessibility

Our service requires clear and safe access to your waste containers. When containers are surrounded by excess trash or other obstructions that prevent safe handling, our CurbRunners may be unable to complete the service. In such cases, no service credits, refunds, or adjustments will be provided. For situations involving excess waste that cannot fit in your standard containers, please visit our website to request a separate on-demand waste removal service. This supplemental service will be billed independently from your regular subscription. We appreciate your help in maintaining clear access paths for our service providers.

Weather-Related Service Modifications

The wellbeing of our customers and service providers remains our top priority. During severe weather conditions – including but not limited to heavy rain, ice, extreme winds, or snow – CurbCaddie reserves the right to postpone, reschedule, or cancel services without prior notification. We will not issue credits, refunds, or adjustments for services that cannot be completed due to adverse weather conditions. We appreciate your understanding as we navigate these safety-first decisions during challenging weather situations.

Road Access Limitations

When road closures, construction, or other access restrictions prevent our CurbRunners from reaching your property, CurbCaddie cannot be held responsible for incomplete service. No service credits, refunds, or adjustments will be provided when access limitations beyond our control prevent service completion. We appreciate your understanding when navigating these unpredictable circumstances.

Container Cleanliness Requirements

For the health and safety of our service providers, CurbCaddie reserves the right to decline service if your waste containers are excessively unsanitary, emit strong odors, or present health hazards. Property owners are responsible for maintaining their containers in reasonably clean condition. If you receive notifications, we will alert you via text message or email when containers require cleaning. Continued issues may result in service suspension until the situation is resolved. No service credits, refunds, or adjustments will be issued when service cannot be provided due to unsanitary container conditions.

Technical Service Limitations

While CurbCaddie employs robust systems to ensure reliable service delivery, we cannot accept responsibility for service disruptions caused by unforeseen technical or telecommunications issues. Though rare, variables including third-party applications, hardware limitations, and cellular service interruptions may occasionally impact our service delivery. When technical issues beyond our control prevent service completion, no service credits, refunds, or adjustments will be provided. We are committed to resolving any technical challenges promptly and effectively to minimize service disruptions.

Holiday Schedule Accommodations

During holiday periods, CurbCaddie makes diligent efforts to adapt our service schedule to align with municipal collection schedule changes. However, due to varying holiday observances across different municipalities and inconsistencies in how revised schedules are implemented, we cannot accept liability for collection difficulties during holiday periods. No service credits, refunds, or adjustments will be issued for service challenges related to holiday schedule modifications. We appreciate your understanding as we navigate these seasonal variations.

Vacation Rental Property Considerations

HOA Compliance: For properties used as vacation rentals rather than primary residences, CurbCaddie is not responsible for any homeowner association notices, fines, or penalties related to improper waste container management. Property owners must ensure compliance with all HOA rules regarding waste management and agree to indemnify CurbCaddie against any consequences resulting from HOA violations.

Guest Interaction Protocol: For vacation rental properties, our CurbRunners may determine that service is inappropriate if guests are present and service might cause disturbance or discomfort. We prioritize both guest experience and our team's comfort, and will not provide service when there's potential for guest disruption. No service credits, refunds, or adjustments will be provided when guest presence prevents service completion.

Force Majeure

Neither CurbCaddie nor the customer shall bear responsibility for service failures or delays resulting from circumstances beyond reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, government actions, pandemics, labor disputes, equipment shortages, utility failures, transportation disruptions, or any other event that cannot reasonably be anticipated or controlled. During such events, service obligations may be temporarily suspended as necessary. The affected party will promptly notify the other regarding force majeure conditions and expected duration. If conditions persist beyond 30 days, either party may terminate the agreement with written notice.

Customer Satisfaction Commitment

Your complete satisfaction is our primary objective. If you feel a service was not completed to satisfactory standards, please notify CurbCaddie within 7 days (preferably sooner) so we can promptly investigate and resolve the matter to your satisfaction. Timely notification helps us address concerns efficiently.

Service Modifications

CurbCaddie may modify, suspend, limit, or discontinue any aspect of our service without prior notice. We reserve the right to amend any terms of this Agreement at our discretion by publishing revised terms on our website. Your continued use of CurbCaddie services after such revisions constitutes acceptance of the updated terms.

Dispute Resolution

Any disputes or claims arising from this Agreement or CurbCaddie services are subject to binding arbitration, governing law provisions, warranty disclaimers, liability limitations, and all other terms specified in the CurbCaddie Conditions of Use. By using our services, you agree to be bound by these dispute resolution terms.

Liability Disclaimer

Under this agreement, CurbCaddie accepts no responsibility for damage to waste or recycling containers. Furthermore, CurbCaddie is not liable for property damage resulting from natural events, fire, vandalism, misuse, or abuse. CurbCaddie will not be responsible for damage to vehicles that contact or collide with waste containers in any manner.

Service Refusal Rights

CurbCaddie maintains the absolute right to decline service to any property at its sole discretion for any reason. We may exercise this right without providing explanation, and no liability will result from service refusal decisions. Factors influencing service refusal may include (but are not limited to) safety considerations, property conditions, terms violation, access difficulties, or any other circumstances deemed relevant by CurbCaddie.

Pricing

You agree to pay CurbCaddie the current monthly recurring service fee plus applicable sales taxes. As of January 1st, 2025, the monthly base service fee is $49 plus applicable sales taxes. CurbCaddie reserves the right to increase or decrease the monthly service fee at any time and at its sole discretion.

Change in Price

Although CurbCaddie makes every effort to remain as competitive as possible and offer the most reasonable prices, some cost increases to the service provided may be beyond our control. In the event that CurbCaddie changes the monthly service fee, CurbCaddie will provide you 2 months written notice of any change. As always you have the option to cancel at any time if you do not agree with the change in price. If you choose not to cancel, you will be billed and charged the new recurring monthly service fee.

Billing

Service is billed at the beginning of each month and is billed on a recurring monthly basis to ensure uninterrupted service. Unless a specific request is made to cancel the service, billing will continue on a recurring monthly basis. All applicable local, State, and/or Federal taxes will be added to the current recurring monthly service fee.

Recurring Payment Terms

By accepting these terms and enrolling in your selected Payment Plan, you authorize CurbCaddie to bill the Payment Method and Account you specified according to your chosen plan. Your CurbCaddie service automatically renews at the end of each billing period (monthly, semi-annual, or annual) unless canceled according to our terms. CurbCaddie will automatically charge your Payment Method for each renewal unless you cancel per our cancellation policy.

Payments and Account Management

You agree to maintain sufficient funds or credit limit on your Payment Method to cover all charges. Automatic charges occur on the monthly Billing Date according to your Payment Plan. CurbCaddie may subscribe to account updater services that allow your payment provider to automatically update card information in our system. You understand that if your payment details change, your provider may share this updated information with CurbCaddie to maintain uninterrupted service.

Electronic Communications

Except for an initial confirmation email for your Payment Plan, you may not receive payment receipts for each transaction. This confirmation serves as your primary notification of payments under your plan. You acknowledge that CurbCaddie may not provide advance notice before charges to your Payment Method.

Account Information Maintenance

You are responsible for maintaining current Payment Method and email contact information throughout your service period to ensure uninterrupted service and proper communications.

Declined Payment Protocol

If your Payment Method is declined, you authorize CurbCaddie to attempt processing daily for up to twenty (20) consecutive days. If unsuccessful after this period and you have a recurring plan, you authorize attempts for two (2) additional consecutive months to maintain your service continuity.

Cancellation

To cancel service, you must provide a 30-day advanced notice prior to your next billing cycle by submitting a cancellation request at curbcaddie.com/contact, except in circumstances where Enterprise pricing has been granted. Note that service is billed monthly, and no partial credits or refunds will be issued. For accounts with multiple properties, notice of cancellation must be done prior to the upcoming billing cycle in writing to contact@curbcaddie.com. Invoices issued before a cancellation request will not be adjusted or revised to reflect the cancellation under any circumstances.

A cancellation number will be provided as confirmation that subscription has been canceled and the property removed from service. Please conserve this confirmation number as evidence of cancellation. CurbCaddie's failure to enforce a cancellation fee or any other provisions of these Terms and Conditions shall not be construed as a waiver of the right to assert any such terms on any future occasion.

Electronic Signature Agreement

Electronic signatures on this Agreement, whether through clicking "I Agree" buttons or digital signing tools, constitute legally binding equivalents to traditional handwritten signatures. Both parties acknowledge that no third-party verification or certification authority is required to validate these electronic signatures. The absence of such certification does not affect the enforceability of electronic signatures or this Agreement.

Messaging Terms

When opting into our messaging service, you'll receive a confirmation message. By opting in, you consent to receive automated marketing and informational messages from CurbCaddie via automatic dialing systems to your provided number or any other number you designate.

Message frequency varies based on your interaction with CurbCaddie. We reserve the right to adjust message frequency and may change the short code or phone number used for communications. Standard message and data rates may apply according to your carrier plan. Your wireless provider bears no responsibility for delayed or undelivered messages.

Your consent to receive marketing messages is entirely voluntary and not a condition of purchase. You may cancel messaging services anytime by texting "STOP" to our number, after which we'll confirm your unsubscription. For help with messaging services, text "HELP" or contact contact@curbcaddie.com.

If changing your mobile number, you agree to text "STOP" from the original number or notify us at contact@curbcaddie.com before the transfer. This notification requirement is a condition of using our messaging service.
